  • Your electronic or physical signature: The takedown notice must be signed by the copyright owner or a person authorized to act on their behalf.

3. Response to DMCA Takedown Notices

Upon receiving a valid DMCA Takedown Notice, we will:

  • Investigate the claim and, if valid, remove or disable access to the infringing content.
  • Notify the user who uploaded the content of the removal and provide them with a copy of the takedown notice.
  • If necessary, retain the removed content for future reference in case of a counter-notification.

Please note that knowingly submitting a false claim of copyright infringement is illegal and may result in legal consequences, including damages. Under Section 512(f) of the DMCA, anyone who makes a misrepresentation regarding infringing content may be liable for any damages, including costs and attorneys’ fees, incurred by us, the alleged infringer, or the copyright owner.

4. Filing a Counter-Notification

If your content was removed due to a DMCA Takedown Notice and you believe that the removal was the result of a mistake or misidentification, you may file a counter-notification. To be valid, a counter-notification must include the following information:

  • Your contact information: Your full name, mailing address, phone number, and email address.
  • Identification of the material: A description of the material that was removed or disabled and the location (URL) where it previously appeared on JRRobbins.com.
  • A statement of good faith: Include a statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  • A statement of consent: A statement that you consent to the jurisdiction of the federal court in the district where your address is located, or, if outside the United States, to the jurisdiction of the courts located where JRRobbins.com is based, and that you will accept service of process from the person who filed the original DMCA Takedown Notice or their agent.
  • Your electronic or physical signature: The counter-notification must be signed by you or your authorized representative.

5. Response to Counter-Notifications

Upon receiving a valid counter-notification, we will:

  • Forward the counter-notification to the party who filed the original DMCA Takedown Notice.
  • Restore the removed content to the Website within 10-14 business days unless the original complainant notifies us that they have filed a court action seeking to prevent further infringement of the material in question.

Please note that knowingly submitting a false counter-notification may result in legal consequences. Under Section 512(f) of the DMCA, anyone who makes a misrepresentation in a counter-notice may be liable for any damages, including costs and attorneys’ fees, incurred by the copyright owner, JRRobbins.com, or the original complainant.

6. Repeat Infringers

In accordance with the DMCA and other applicable laws, JRRobbins.com maintains a policy to terminate, in appropriate circumstances, users who are deemed repeat infringers. A repeat infringer is a user who has been the subject of multiple valid DMCA Takedown Notices. We reserve the right to terminate accounts of repeat infringers at our discretion.
